1. Scope

1.1 These Terms of Service (the “Terms”) govern your use of the unCoded software (including any free and paid versions), its APIs, documentation and other materials (collectively, the “Software”), operated by Arrow Trade AG (the “Provider”).

1.2 “You”, “your” and “User(s)” refers to any individual or legal entity using the Software. If you use the Software on behalf of a company or other legal entity, you represent that you have authority to bind that entity to these Terms.

1.3 By using the Software or clicking “Accept” when prompted, you agree to be bound by these Terms.

1.4 If you do not agree, you must not use the Software.

1.5 These Terms are exclusive. Any conflicting terms you propose are void unless expressly agreed in writing by the Provider.

1. Scope of the Software

2.1 Core Features

• Automated trade execution based on your predefined configurations

• Customizable parameters such as trading volumes, profit targets and risk profiles

• Integration with Binance for order execution and Telegram for notifications

2.2 Limitations and User Responsibility

• No guarantee of profit; performance depends entirely on your configurations

• You assume all risks of digital-asset trading, including market volatility and potential loss of funds

• The Software does not provide financial, investment or trading advice; seek independent advice before trading

• Self-hosting is required; you must procure, configure and maintain your own server environment

• Only exchanges and services explicitly supported by the Provider are guaranteed compatible

2.3 Third-Party Services

• All trades and funds remain directly on the chosen exchange under its own terms and conditions

• Telegram is used solely for notifications; you are responsible for securing your Telegram account

2.4 Disclaimer for Third-Party Services

• The Software relies on external services (for example, Binance, Telegram) and the Provider disclaims liability for any errors, downtime or interruptions in those services

2.5 Updates and Support

• The Software is provided “as is” without any guaranteed uptime or error-free operation

• The Provider may release updates at its discretion, all of which remain subject to these Terms

• No hosting or server-related support is provided beyond the included documentation

2.6 Protection of Sensitive Data

• You are solely responsible for storing and managing your API keys, license keys and Telegram identifiers

• The Provider does not store or have access to your credentials

1. Licensing

Subject to your compliance with these Terms, the Provider grants you a limited, non-transferable, non-sublicensable, revocable, royalty-free license to use the Software.

1. Restrictions

4.1 Personal Restrictions

• You must be at least 18 years old, of sound mind and have the technical knowledge to manage risks

• You may not be prohibited by any law from using the Software

4.2 Local Restrictions

• Use outside Switzerland is at your own risk; the Software may be illegal in some jurisdictions

• The Software is not offered to persons or entities in embargoed or sanctioned jurisdictions

4.3 Suspension

• The Provider may suspend or terminate your access immediately for any breach of these Terms or applicable law

1. General Prohibitions

You must not:

• Violate any applicable law or third-party terms

• Upload unlawful, offensive or harmful content

• Tamper with non-public areas of the Software or its infrastructure

• Bypass security measures of third-party services

• Manipulate trading metrics or results

• Harass or impersonate other users

• Infringe intellectual property rights

• Engage in fraud, market manipulation, money laundering or other illicit activities

• Reverse-engineer or sabotage the Software

• Overload the Software or connected services

• Solicit unrelated services or promotions

1. Intellectual Property and Trademarks

   • The Software remains the exclusive property of the Provider and is licensed, not sold

   • The Provider’s name, logos and trademarks may not be used without prior written permission

2. Confidentiality

Both you and the Provider agree to keep each other’s confidential information strictly private, except as required by law or with written consent.

1. User Representations and Indemnification

8.1 You represent that your use complies with these Terms and all applicable laws. 8.2 You agree to indemnify the Provider against any claims, losses or damages arising from your breach of these Terms or misuse of the Software.

1. Termination

9.1 The Provider may terminate or suspend your access immediately for any breach of these Terms or applicable law. 9.2 You remain responsible for any obligations incurred prior to termination. 9.3 The Provider is not liable for any losses resulting from termination.

1. Warranties and Disclaimers

• The Software is provided “as is” without any express or implied warranties

• No guarantee is made regarding uninterrupted operation, security or suitability

• No financial, investment, tax or legal advice is provided

1. Liability Disclaimer

To the fullest extent permitted by law, the Provider and its affiliates will not be liable for any direct, indirect, incidental or consequential damages arising from your use of the Software. The Provider’s total liability is limited to CHF 100.

1. Force Majeure

The Provider is not liable for failures due to events beyond its control, such as natural disasters, war, strikes or telecommunications outages.

1. Data Processing and Privacy

• The Provider does not collect or store personal data

• Only anonymized performance and usage metrics may be processed in compliance with Swiss data-protection law

1. Changes to These Terms

These Terms may be updated at any time at the Provider’s discretion. Continued use of the Software signifies acceptance of the revised Terms.

• No partnership or agency is created by these Terms

• Failure to enforce any provision does not waive future enforcement

• You may not assign your rights under these Terms; the Provider may

• If any provision is invalid, the remainder will continue in effect

1. Applicable Law and Jurisdiction

These Terms are governed by Swiss law. Disputes shall be brought exclusively in the courts of Brig-Glis, Switzerland, with appeal to the Swiss Federal Court.
